Powerless Against the Corrupt Free Nutritious – The decision by the Corruption Eradication Commission (KPK) to step back from investigating corruption linked to the free nutritious meal initiative has raised concerns about its effectiveness as an anti-graft body. This move may also open the door for potential conflicts of interest, particularly with the Attorney General’s Office (AGO).

From Investigation to Prevention

The KPK’s official justification for halting its inquiry seemed to prioritize procedural formality, citing the need to avoid overlapping efforts with the AGO. However, the commission had initially been the first to probe alleged misconduct in the MBG program, which is a key initiative under President Prabowo Subianto’s leadership. The withdrawal suggests a shift in focus from direct action to risk assessment, limiting its ability to uncover deeper wrongdoing.

On June 3, 2026, the AGO named BGN Chief Dadan Hindayana, along with his deputies Sony Sonjaya and Lodewyk Pusung, as suspects in the case. These individuals are accused of manipulating the nutrition fulfillment service units (SPPGs), approving substandard providers, and inflating costs during procurement processes.

Tempo learned that the KPK had been planning a major operation, but the AGO acted first. Instead of pressing forward, the commission redirected its efforts toward identifying corruption-prone areas within the MBG framework, signaling a retreat from aggressive enforcement.

Structural Changes and Political Vulnerability

Law No. 19/2019 has reshaped the KPK’s role, transitioning it from an independent anti-corruption body to a more bureaucratic law enforcement agency. Now, its investigative powers are constrained by internal approvals, and it operates under the executive branch’s influence. This dependency weakens its ability to conduct searches, wiretaps, or asset seizures without prior consent.

Despite these limitations, the KPK could still play a critical role in the MBG case. If the AGO is probing procurement irregularities and SPPG distribution, the commission could track financial flows to uncover broader conspiracies. Failing to do so risks reinforcing perceptions that the KPK has been sidelined to protect certain interests.

One of the suspects, Lodewyk Pusung, is a retired military officer. This creates a potential conflict of interest, as the AGO’s Deputy for Military Crimes has the authority to investigate military figures. Such alignment could cast doubt on the impartiality of the investigation, especially if the KPK remains passive.

Had the KPK continued its probe, it would have established a balance of power among law enforcement agencies. This cross-checking is vital in a case as complex and politically sensitive as MBG.
